 Law Changes Affecting Maryland Learner's Permit and Provisional License Holders

Effective October 1, 2009, Maryland's laws regarding new Graduated License System (GLS) Learner's Permit holder applicants will be changing. This notice is designed to help holders of these products understand the impact of those changes.

Note:   Effective October 1, 2012 an individual at least 25 years old who holds a (Graduated Licensing System - GLS) learner’s permit and has not been convicted of, or granted Probation Before Judgment (PBJ) for a moving violation, is eligible to take a skills driving test after holding this permit for a minimum of 45 days if they:

  1. Have completed a Maryland MVA approved standardized driver education program consisting of at least 30 hours of classroom instruction and at least 6 hours of behind the wheel instruction training and;
  2. Have completed an additional minimum of at least 14 hours of supervised behind the wheel driving (3 hours of which must occur during the period beginning 30 minutes before sunset and ending 30 minutes after sunrise) and have an eligible supervising driver complete a Practice Skills log and certification page .

Notes: 

  1. If the applicant has been convicted of or given a PBJ for a moving violation, they are required to hold the permit for a minimum of 9 months following the most recent date the individual was convicted of, or granted a PBJ for a moving violation, and meet the rest of the above mentioned GLS requirements before they are eligible to take a skills driving test.
  2. If an applicant is under 25 years old when they obtain their first GLS learner’s permit and then turns 25 afterwards, the MVA will permit the applicant to take a skills driving test if they have held the permit at least 45 days (the 45 days may include the days the applicant held the permit before they turned 25 as well as afterwards), they have completed at least 14 hours of supervised driving as described above as well as the required driver’s education program and have an eligible supervising driver complete a Practice Skills Log and certification page for them.
  3. If the applicant has been convicted of or given a PBJ for a moving violation, they are required to hold them permit for a minimum of 9 months following the most recent date the individual was convicted of, or granted a PBJ for a moving violation, and meet the rest of the above mentioned GLS requirements before they are eligible to take a skills driving test.

 Learner's Permit Holders (Current laws if under 25 years old):

  • Must hold the learner's permit for at least nine (9) months before being eligible for a provisional license.  The nine (9) month period will be restarted should the person be convicted or granted probation before judgment (PBJ) for a moving violation. *
  • Must be at least age sixteen (16) years and six (6) months before being eligible for a provisional license after holding the learner's permit for the mandatory nine (9) months. 
  • Must still complete the Maryland Graduated Licensing  System requirements and have at least sixty (60) hours of driving practice with someone at least age twenty-one (21) who has held a driver's license for at least three (3) years to be eligible for a provisional license.  At least ten (10) of the practice hours must occur during the period beginning thirty (30) minutes before sunset and ending thirty (30) minutes after sunrise.  A practice driving skills log must be signed by an individual certifying the practice driving requirements were fulfilled.
  • Under the age of 16 must submit a completed Learner's Permit School Attendance Certification form (DL-300)  This form must be validated by a school official or authorized home school coordinator prior to applying for your permit.
  • Under age eighteen (18) are still prohibited from using a wireless communication device (including a cell phone) while operating a motor vehicle, except when contacting 911 for an emergency.  Violations may result in a suspension of your driving privilege.
  • New Drivers (GLS) must complete a Maryland Motor Vehicle Administration (MVA) approved Driver's Education Course consisting of a minimum of thirty (30) hours classroom instruction and six (6) hours behind the wheel instruction training.  The Maryland driving school will electronically submit verification of completion to the MVA.  New drivers must also present the completed skills practice log and completed certification page along with their unexpired Maryland learner's instructional permit.
  • Out-of-State Driver’s Education certificates are not typically accepted by the MVA.  Currently, the MVA has only approved certain specific certificates issues by the Delaware Board of Education, that physically state that the certificate has been Approved by the Maryland Motor Vehicle Administration.  No other out-of-state certificates are currently accepted

Provisional License Holders:

  • Must hold the provisional license for a minimum of eighteen (18) consecutive months without violation before conversion to a full license.  The eighteen (18) month period will be restarted for any convictions or PBJ's for moving violations or violations of license restrictions.
  • Cannot obtain a full license until they reach the age of eighteen (18).
  • Who are under age eighteen (18) are still prohibited from using a wireless communication device (including a cell phone) while operating a motor vehicle, except when contacting 911 for an emergency.  Violations may result in a suspension of your driving privilege.
  • Under age eighteen (18) are still prohibited from transporting any passenger under age eighteen (18) for 151 days after the provisional license is issued.  There is an exception for family members (spouse, daughter, son, stepdaughter, stepson, sister, brother, stepsister, or stepbrother) and relatives living at the driver’s address.  Violations may result in a suspension of your driving privilege.
  • Will be ineligible for a "Probation Before Judgment" (PBJ) ruling from the court if the defendant has previously received a PBJ for a moving violation or criminal offense.
  • Can have their license canceled if, while they are still a minor, the cosigner of the license application requests in writing that the MVA cancel the product.
  • Under age eighteen (18) face serious penalties for repeated violations and offenses. Penalties for repeated violations can include:
    • Mandatory completion of a driver improvement program
    • The retaking of all law and driving skills tests.
    • License suspension for an accumulation of excessive points within a 12-month period, for repeated convictions or PBJ’s during the provisional period or for a conviction on an offense classified as high risk driving.
    • Revocation of your driver's license
